THE MARINE WORKS (ENVIRONMENTAL IMPACT ASSESSMENT) REGULATIONS 2007

NOTIFICATION OF ENVIRONMENTAL IMPACT ASSESSMENT CONSENT DECISION

ANGLESEY SKERRIES CABLE CORRIDOR AND LANDFALL

 

An application was made by Sea Generation (Wales) Ltd for  a marine licence under Part 4 of the Marine and Coastal Access Act 2009.

The application was to vary the cable corridor route and landfall location within Marine Licence 11/17/ML.   Marine Licence 11/17/ML consented a cable corridor achieving landfall between Carmel Head and Hen Borth Bay. The amended cable corridor route results in the installation of a single cable routed from the array around the coast to the North East to Cemaes Bay.

The works described in the application comprise part of a project, which it was agreed because of the location, size and nature of the works should be subject to an Environmental Impact Assessment (EIA) under the Directive 85/337EEC on the assessment of the effects of certain public and private projects on the environment (EIA Directive).  The EIA Directive has been transposed into UK law for marine works (including works requiring a marine licence) by the Marine Works (Environmental Impact Assessment) Regulations 2007 (as amended) (MWR). 

The application and Environmental Statement (ES) were advertised in the press during July 2013 to enable interested parties to review and make representations on the applications if necessary.  The applications were also formally consulted on with a range of consultation bodies, which were considered likely to have an interest in the project in accordance with regulations 16 and 17 of the MWR. 

The Marine Licensing Team, on behalf of the Welsh Ministers, has carried out an EIA under the MWR in relation to the project and, in accordance with Regulation 22, has decided to grant EIA consent for the project, subject to certain conditions being imposed.

The sale will take place by virtue of the engrossment of judgments of the Aruba Court of First Instance, dated 11 March 2014 and 14 March 2014. The enforced sale takes place for the recovery of USD 332,701, to be increased with penalties eventually to be forfeited, to be increased with USD 1,425.00 for each day as from 28 February 2014 up to and including the day of the auction, pursuant to the above judgments without prejudice to further sums for principal, interest and costs, owed to the Creditors.

Sea-going vessel, type motor tanker, built in 2003, in Mihara, Hiroshima, Japan on the yard of Koyo Dockyard Co., Ltd. - one deck - length 236.28 m - extreme breadth 42.00 m - maximum draught 21.30 m – 58,136 tons gross register - 31,909 tons net register - propulsion by a Mitsui-Man-B&W 6S50MC-C diesel engine with a

capacity of 13,530 kW. This description is provided without guaranteeing the correctness or completeness

hereof.

The Vessel will be sold “as is where is”. The Vessel is presently anchored on Aruba roads. Inspection of the Vessel can only take place after prior permission of the Attorneys of the Creditors.

The Vessel will be sold to the highest bidder in the auction. The conditions of sale have been filed at the office of the clerk of the Aruba Court of First Instance.

PRIVATIZATION IN POLAND’S LARGEST SEAPORT

 

Port of Gdansk Authority SA, one of the most rapidly developing ports in the Baltic Sea, has commenced the privatization of Port of Gdansk Cargo Logistics SA (Port Gdański Eksploatacja SA, a joint stock Company under Polish Law), its largest multipurpose cargo handling operator.

 

The Port of Gdansk is Poland’s largest port designated by the European Union as the core port of the TEN-T Baltic Adriatic Corridor no.1. With 30.3 million tonnes of cargo handled in 2013, being a record figure in a 1000-year long history of the Port of Gdansk, it ranked seventh in the Baltic Sea and second in terms of the number of containers handled.

 

Another stage of the Port of Gdansk’s intense development is a decision to sell a block of shares in Port of Gdansk Cargo Logistics SA, a stevedoring company that provides cargo handling and storage services for goods delivered by sea, road and rail, to one of the largest seaports of Central and Eastern Europe.

 

Port of Gdansk Cargo Logistics SA is a port operator focused mainly on handling general cargo, including containerized and bulk cargo, that pursues its business on over 90 ha of the Port of Gdansk’s attractively located plots.

 

The purchase of a block of almost 100% of shares in Port of Gdansk Cargo Logistics SA (99.1% of shares belong to Port of Gdansk Authority SA and the outstanding 0.09% is subject to compulsory buyout) is currently one of the most interesting investment options on the maritime market in Central and Eastern Europe.

 

Gdansk as the largest port located in Poland, is a commercial centre that in 2013 handled in its terminals and quays the cargo worth of roughly EUR 40 billion, which accounts for 50% of Poland’s (the sixth largest European market) income.

Notice is hereby given that Port Charges on Vessels & Goods, Conservancy, Ancillary Services, Pilotage, Quay & Special Rent, Environmental Levy and Waste Reception Levy for the Port of Liverpool and Ship Dues, Canal Tolls, Pilotage and Towage for the Port of Manchester (Manchester Ship Canal) shall be increased with effect from 1st April 2014 inclusive.

 

All other Port Charges shall be provided upon request.

 

Revised schedules of charges shall be made available in due course.

Having read the papers filed of record and having heard Counsel for the Applicants:

 

IT IS ORDERED THAT:

1. This application shall be heard as a matter of urgency in terms of Rule 6 (12).

2. A rule nisi is granted calling upon all interested parties to show cause at 10h00 on Tuesday 08 April 2014 why an order should not be granted:

2.1. Recognising the order granted at the instance of the Applicants by the US Bankruptcy Court for the Southern District of New York, under case number

13-23060(RDD) on 27 January 2014 (“the Order”), a copy of which is annexed marked annexure “Y”, is recognised.

2.2. That the provisions of the Order, including in particular the stay and related provisions contained in Article 31 of the Order and Article 9.7 of the Reorgani sation Plan referred to therein, shall apply and be of full force and effect in the Republic in regard to the Applicants and any assets of any of the Applicants situated in the Republic and/or in its territorial waters, at any time.

2.3. Granting a stay against the commencement or continuation, including the issuance or employment of process, of judicial, administrative or other action or

proceeding against the Applicants and/or against their assets (in particular in regard to any vessels owned, operated and/or chartered by or on behalf of any of

the Applicants, including those listed in Annexure “B” hereto) that was or could have been commenced before the commencement of the Applicants’ Chapter

11 cases or 1 July 2013 or recovering a claim against the Applicants that arose before the commencement of the Applicants’ Chapter 11 cases or 1 July 2013

whether by way of an action in rem, an action in personam and/or in terms of section 3(6) read with section 3(7), and /or section 4(4)(d) and/or 5 (3) of the

Admiralty Jurisdiction Regulation Act 105 of 1983, or otherwise.

3. Pending the return day, paragraphs 2.1, 2.2 and 2.3 shall operate as an interim order.

4. To the extent necessary, the automatic stay recognised by this Honourable Court on 12 September 2013 under case no. 14873/13 is discharged and shall ipso facto lapse. 

5. Service of this Order shall be effected:

5.1. by delivery to each of the Registrars of this Honourable Court and of the High Courts of Port Elizabeth, East London and Durban; and

5.2. by way of publication of this Order together with only annexure “A” thereto and the provisions of Article 31 of the Order, in one edition each of the Business

Day, the Cape Times and Lloyd’s List.

APPLICATION FOR A MARINE LICENCE TO CONSTRUCT A TIDAL LAGOON SCHEME, SWANSEA BAY

Notice is hereby given that Tidal Lagoon (Swansea Bay) Ltd.  has applied to the Natural Resources Wales Marine Licensing Team, acting on behalf of the Licensing Authority, for a Marine Licence to construct a tidal lagoon scheme, including but not limited to; an approximately 9.5km long U-shaped sea wall,

turbine and sluice gate housing containing 16 hydro turbines, grid connection works, operation, control and

maintenance facilities, visitor centre facilities, navigation and safety warning systems, and undertake an area of

dredging. An Environmental Statement has been prepared for this project in accordance with the Marine Works

(Environmental Impact Assessment) Regulations 2007 (as amended).

Notice of proposed application for a development consent order (DCO) to construct and operate the offshore wind farm Rhiannon Wind Farm

 

1. Notice is hereby given that Rhiannon Wind Farm Limited (the Applicant) of Millstream, Maidenhead Road, Windsor, SL4 5GD intends to apply

to the Secretary of State under section 37 of the Planning Act 2008 (“The Act”) for a development consent order (DCO) to authorise the

construction and operation of Rhiannon Wind Farm (“the Development”)

 

2. Rhiannon Wind Farm is the first wind farm proposed in the Irish Sea Zone in the Irish Sea.  It covers a total area of 497km² and is situated 19km off the coast of Anglesey, 34km from the Isle of Man, and 60km from Cumbria.  It is proposed to have a generating capacity of up to 2.2GW.   Given that the generating capacity of the Development is more than 100 megawatts, an application for development consent is required to be made to the Secretary of State under the provisions of the Act.

 

3. The Applicant’s proposed application to the Secretary of State seeks development consent for the construction and operation of Rhiannon Wind Farm and will incorporate the following elements:

 

Offshore 

- Up to 440 wind turbines with supporting tower structures, foundations fixed to the seabed and associated support and access structures;

- Up to 8 Alternating Current (AC) offshore substations;

- Up to 4 Direct Current (DC) offshore converter substations;

- Up to 4 accommodation platforms;

- Intra-array cables laid on or beneath the sea bed between turbines and substations;

- Up to 12 export cables laid on or beneath the sea bed which would bring the power to shore on the Isle of Anglesey

- Ancillary works including: cable and pipeline crossing structures; protection against foundation scour and subsea damage, cable protection measures and vessel-mooring facilities

 

4. Offshore Works within Welsh Territorial Water associated with Rhiannon Wind Farm do not form part of the DCO application and will be consented by separately under the Marine and Coastal Access Act 2009.

 

5. Onshore works associated with Rhiannon Wind farm will be located on the Isle of Anglesey and do not form part of the DCO application.  These will be consented separately under the Town and Country Planning Act 1990 and will be subject to a separate Environmental Impact Assessment under the Town and Country (Environmental Impact Assessment) Regulations  2011 (as amended).   

 

6. The DCO will include a number of other provisions, including those which:

- allow all or part of the benefit and rights of the DCO to be transferred to other person(s); and

- include a deemed Marine Licence.

 

The Development is “EIA development” for the purposes of the Infrastructure Planning (Environmental Impact Assessment) Regulations 2011 (as amended).   The Application includes an Environmental Impact Assessment and the Applicant will be consulting the public on the anticipated environmental impacts of the proposals, as well as the overall proposal. Accordingly, the Applicant will be making preliminary environmental

information (PEI) available during the consultation period. The PEI consisting of documents, plans and maps showing the nature and location of the proposed development, including the preliminary information compiled to date on environmental impacts, will be available to download from 20 March 2014 on http://www.celticarray.com   and to view from 20 March 2014 to 19 May 2014, during opening hours at the places set out

below. The PEI also includes a draft Environmental Statement and draft Non-Technical Summary of the Environmental Statement and will include some information about the onshore works.

NOTICE OF ACCEPTANCE OF APPLICATION FOR A DEVELOPMENT CONSENT ORDER BY THE PLANNING INSPECTORATE

 

Notice is hereby given that, on behalf of the Secretary of State for Energy and Climate Change, the Planning Inspectorate has accepted an

application made by Tidal Lagoon (Swansea Bay) plc (the “Applicant”) of The Lypiatts, 15 Lansdown Road, Cheltenham, Gloucestershire GL50 2JA for a development consent order under the Planning Act 2008 (the “Application”). The Application was made on 7 February 2014 and

accepted on 6 March 2014 with the above reference.

The Application is for development consent to construct and operate a tidal powered generating station on the seabed south of and connecting to Swansea Docks (between the dredged channels of the Rivers Tawe and Neath) and on other land (including foreshore) nearby in and adjacent to the City and County of Swansea and in the Country Borough of Neath Port Talbot (the “Project”). The Project is a nationally significant

infrastructure project under section 14 and section 15 of the Planning Act 2008.

 

The Project

The proposed development consent order will authorise:

1. construction and operation of hydro turbines and generation with a nominal rated  capacity of 240MW contained within a turbine and sluice gate housing structure; 

2. construction of circa 9.5km of new seawall and related facilities impounding around 11.5km2 of seabed and foreshore together with dredging works;

3. electricity transmission infrastructure required for the export of electrical power by the Project via Baglan Bay substation in the County Borough of Neath Port Talbot including cables laid offshore and onshore, electricity step-up facilities and other electricity transmission facilities;

4. the compulsory acquisition of land including rights in or over land required for the purposes of the Project, or to facilitate or incidental to the Project; and

5. development including plant, equipment and buildings comprised in the Project including:

5.1 construction sites, lay-down areas, working areas and temporary works and structures;

5.2 site access, internal site roads, vehicle parking;

5.3 landscaping;

5.4 tourism, recreation, sporting and visitor amenities and facilities comprised in the Project;

5.5 navigational lighting and safety warning systems;

5.6 operation and control facilities; and

5.7 foul drainage provision and surface water management systems;

6. permanent and/or temporary changes to the highway network for the Project and other access facilities;

7. the application and/or disapplication of legislation relevant to the Project including inter alia legislation relating to the compulsory acquisition of land and the application of legislation relating to development consent obligations;

8. the making of byelaws for the purposes of regulating the operation of the Project, including restrictions on admission and access to the seawalls and on activities and recreational pursuits within the footprint of the Project; and

9. such ancillary, incidental and consequential provisions, permits or consents as are necessary and/or convenient.

Environmental Impact Assessment

The Project is environmental impact assessment development. Accordingly, an environmental statement accompanies the Application.

Pursuant to the order for sale of the Vessel made by the High Court of the Hong Kong Special Administrative Region on the 10 January 2014 and 19 February 2014 respectively tenders are invited for the purchase of the Vessel (a general description of which is set out below) upon the following terms.

1. The Vessel is offered for sale as she lies in the waters of Hong Kong in her “as is” “where is” condition at the date of delivery without any warranties or guarantees.  The Vessel is sold free from incumbrances, with everything on board belonging to her but excluding any equipment on hire.

2. No error or misdescription in this invitation or otherwise by representatives of the Government or the High Court of the Hong Kong Special

Administrative Region shall entitle the successful tenderer (”the Buyer”) to annul the sale.

3. Tenderers are advised to make all and any such enquiries as they think fit.  Permission to inspect the Vessel may be obtained from the Chief Bailiff.

4. Tenders for the purchase of the Vessel must:

(a) be in writing addressed to the Registrar of the High Court, Hong Kong Special Administrative Region;

(b) be in a sealed envelope so addressed and marked “HCAJ 185 of 2013 – CONFIDENTIAL”;

(c) be accompanied by way of deposit by a cashier’s order or bank draft drawn by a Hong Kong bank or a bank having a branch office or banking correspondents in Hong Kong or certified cheque drawn on such a bank of 10% of the offer payable to “Registrar, High Court” and crossed in

“HCAJ  185  of  2013” (the “Deposit”);

(d) be expressed to be irrevocable until 26 March 2014;

(e) reach the Registrar c/o Chief Bailiff (Administration & Admiralty) at  Bailiff Office, LG 3/F, High Court Building, 38 Queensway, Hong Kong not later than 2:00 p.m. on 19 March 2014, otherwise such tenders will be treated as invalid; and

(f) be expressed in Hong Kong Dollars or United States Dollars with payment of the Deposit being made in the same currency as the tender.

5. The Registrar is not bound to accept the highest or any tender.

6. If a tender is accepted the balance (plus the sum payable for bunker fuel) of the purchase price also in the form of a cashier’s order, bank draft or certified cheque payable as aforesaid must be paid within 7 days of the acceptance of the tender and if not so paid the deposit of 10% will be forfeited in which event the Registrar will be at liberty to sell the Vessel to any other party or parties.

7. The Buyer shall within 7 days of the acceptance of the tender pay by the aforesaid methods the Hong Kong market price for the bunker fuel remaining on

board on the date of delivery, such quantity and price to be determined by the Chief Bailiff or his agent.

8. Upon payment of the balance of the purchase price, a bill of sale will be duly executed on behalf of the High Court of the Hong Kong Special

Administrative Region in favour of the Buyer.

9. The Registrar may in his discretion agree that the Vessel be sold to a nominee of the Buyer. Such nominee and the Buyer shall sign an addendum to this Invitation to Tender in such form as the Registrar may require. Any nomination shall be made no later than 3 working days prior to the delivery of the Vessel.  Any nomination made by the Buyer shall be irrevocable.  No further nomination is permitted.

10. Deposits will be refunded to unsuccessful tenderers.

11. Any tenderer who does not receive notice by 26 March 2014 that his tender has been accepted may assume that such tender has been rejected.

12. Should the Vessel become a total loss (or be accepted by underwriters as a constructive total loss) before delivery of the Vessel to the Buyer the sale shall be null and void and the Deposit will be refunded to the Buyer.

13. The Buyer shall be liable for any fees duties taxes or dues of whatever nature which may become payable upon the purchase and transfer of the Vessel.

14. On completion of the sale the Buyer will assume all responsibility for complying with all Hong Kong Marine Department directions regarding the Vessel.

15. This invitation and the sale of the Vessel is made and effected without any liability of whatsoever nature of the High Court of the Hong Kong Special Administrative Region or its officers, employees or agents.

3. Freight Forwarding Fee :

 

Maximum Freight forwarding Commission is pegged @ 2% of freight.  While submitting EOI, bidders may quote any commission upto a maximum of 2% on ocean freight.

5. Ministry of Shipping reserves the right to reject any/all offers (EOIs) without assigning any reason whatsoever.

The ship or vessel “MONTANA“ (the “Vessel”)

 

Pursuant to the order for sale of the Vessel made by the High Court of the Hong Kong Special Administrative Region on the 10 January 2014 tenders are invited for the

purchase of the Vessel (a general description of which is set out below) upon the following terms.

 

1. The Vessel is offered for sale as she lies in the waters of Hong Kong in her “as is” “where is” condition at the date of delivery without any warranties or guarantees.  The Vessel is sold free from incumbrances, with everything on board belonging to her but excluding any equipment on hire.

2. No error or misdescription in this invitation or otherwise by representatives of the Government or the High Court of the Hong Kong Special Administrative

Region shall entitle the successful tenderer (”the Buyer”) to annul the sale. 

3. Tenderers are advised to make all and any such enquiries as they think fit.  Permission to inspect the Vessel may be obtained from the Chief Bailiff.

4. Tenders for the purchase of the Vessel must:

(a) be in writing addressed to the Registrar of the High Court, Hong Kong Special Administrative Region;

(b) be in a sealed envelope so addressed and marked “HCAJ 185 of 2013 – CONFIDENTIAL”;

(c) be accompanied by way of deposit by a cashier’s order or bank draft drawn by a Hong Kong bank or a bank having a branch office or banking correspondents in Hong Kong or certified cheque drawn on such a bank of 10% of the offer payable to “Registrar, High Court” and crossed in “HCAJ  185  of  2013” (the “Deposit”);

(d) be expressed to be irrevocable until 26 February 2014;

(e) reach the Registrar c/o Chief Bailiff (Administration & Admiralty) at  Bailiff Office, LG 3/F, High Court Building, 38 Queensway, Hong Kong not later than 2:00 p.m. on 19 February 2014, otherwise such tenders will be treated as invalid; and

(f) be expressed in Hong Kong Dollars or United States Dollars with payment of the Deposit being made in the same currency as the tender.

5. The Registrar is not bound to accept the highest or any tender.

6. If a tender is accepted the balance (plus the sum payable for bunker fuel) of the purchase price also in the form of a cashier’s order, bank draft or certified cheque payable as aforesaid must be paid within 7 days of the acceptance of the tender and if not so paid the deposit of 10% will be forfeited in which event the Registrar will be at liberty to sell the Vessel to any other party or parties.

7. The Buyer shall within 7 days of the acceptance of the tender pay by the aforesaid methods the Hong Kong market price for the bunker fuel remaining on board on the date of delivery, such quantity and price to be determined by the Chief Bailiff or his agent.

8. Upon payment of the balance of the purchase price, a bill of sale will be duly executed on behalf of the High Court of the Hong Kong Special Administrative Region in favour of the Buyer.

9. The Registrar may in his discretion agree that the Vessel be sold to a nominee of the Buyer. Such nominee and the Buyer shall sign an addendum to this Invitation to Tender in such form as the Registrar may require. Any nomination shall be made no later than 3 working days prior to the delivery of the Vessel.  Any

nomination made by the Buyer shall be irrevocable.  No further nomination is permitted.

10. Deposits will be refunded to unsuccessful tenderers.

11. Any tenderer who does not receive notice by 26 February 2014 that his tender has been accepted may assume that such tender has been rejected.

12. Should the Vessel become a total loss (or be accepted by underwriters as a constructive total loss) before delivery of the Vessel to the Buyer the sale shall be null and void and the Deposit will be refunded to the Buyer.

13. The Buyer shall be liable for any fees duties taxes or dues of whatever nature which may become payable upon the purchase and transfer of the Vessel.

14. On completion of the sale the Buyer will assume all responsibility for complying with all Hong Kong Marine Department directions regarding the Vessel.

15. This invitation and the sale of the Vessel is made and effected without any liability of whatsoever nature of the High Court of the Hong Kong Special Administrative Region or its officers, employees or agents.

NOTICE OF A DECISION ON AN APPLICATION FOR AN ORDER GRANTING DEVELOPMENT CONSENT

 

The Secretary of State for Transport gives notice under regulation 23 of the Infrastructure Planning (Environmental Impact Assessment) Regulations 2009 that a decision has been made on an application by Able Humber Ports Limited (“AHPL”) of Able House, Billingham Reach Industrial Estate, Billingham TS23 1PX for an order granting development consent under the Planning Act 2008 (“the application”).

The application was for powers to construct and operate a new quay with associated onshore facilities (collectively referred to as the Able Marine Energy Park) on the south bank of the River Humber, north of Immingham, in North Lincolnshire, together with a compensatory environmental habitat on the north bank of the Humber, in the East Riding of Yorkshire. The Order would also authorise AHPL to acquire, compulsorily or by agreement, land and rights in land and to use land for the purposes of the project.

The Secretary of State has decided, following consideration of the report of the Panel who conducted an examination into the application that development consent should be granted for the project, and therefore has decided to make an Order under section 114(1) of the Planning Act 2008.

The Order will not come into force until it has been laid before Parliament and has been brought into operation in accordance with the provisions of the Statutory Orders (Special Procedure) Acts 1945 and 1965. The vessel named MT CGM TIGER, which was (seized) due to unpaid debt and whose registration records, value, date and time of sale, and main features are given below, has been put on sale by auction by Istanbul 9th Execution Office.

 

Notification of the Sale Announcement According to the Article 127 of the Enforcement and Bankruptcy Law (EBL):

With this announcement for sale, it is hereby notified by PUBLICATION to the concerned parties whose names have been provided in the submitted registration records but whose addresses could not be found therein provided that notifications sent to them cannot be served.

 

Complaint to Procedures and Objection according to Article 142 of EBL:

It is hereby notified by publication to the concerned parties in accordance with the Articles 83, 100, 142, 151 of EBL, and Articles 789 and 777 of the Civil Code that, should the auction take place to the account of debts or the sum of sale is paid to the mortgage holder in accordance with the Article 138 of EBL, the concerned parties should follow the sale procedures and submit their petition with due explanations as to their use of their right of complaint and objection to the sale due to the contradiction in procedures in accordance with the Article 142 of EBL.

The subject ship is not registered to Turkish Register of Ships.

 

Existing State:

Under the appraisal conducted by our Office through an expert, the main features of the Panama Flagged ship named MT CGM TIGER with IMO number 8705955, not registered to Turkish Register of Ships, have been found as follows: length overall (loa) 89.42 m, length between perpendiculars (lbp) 82.00 m, width 14.63 m, depth 10.42 m, GRT 2,997RT, net tonnage 899RT. (Additional specs can be found in detail in the file of our Office)

 

Value:

The value assessment for the whole of the ship was found as TL 4,250,000.00.

 

Sale Conditions:

For the ship whose open registration records, construction information and existing state are given above;

 

1st Auction; will be held at ?i?li Brokerage department on the first flat of Istanbul Courthouse (Door No: B2-1B45) between 1100 and 1145 on MONDAY, 24 FEBRUARY 2014. In this auction, sale contract is awarded on condition that the sale price reaches 50% of the appraised value of the ship and that it passes the total of the sum of the receivables of the preferred creditors - if any - and the costs of the auction. And in the absence of such a bidder a second auction is held with the bid of the best bidder is reserved;

 

2nd Auction; will be held at the same place and time on Tuesday, 11 MARCH 2014. If no qualified offer is found in this auction too, the contract for sale of the ship will be awarded to the best bidder at the end of the period provided in the announcement for the auction with the bid of the best bidder is reserved. Auction price should be at least equal to 50% of the the appraised value of property, and it should be more than the total of the preferred creditors' receivables plus the sale and allocation charges. Sale request will be dropped if no bidder comes out with such a sum of bid.

 

a) The bidders are required to submit as down payment a definite letter of guarantee unlimited in time at the sum of 20% of the assessed value of the ship as issued in national currency by a national bank, and the bidders to bid on account of their receivables are required to submit a definite letter of guarantee unlimited in time at the sum of 20% of the receivables of the creditors ranking before them (limited with the 20% of the estimated value of the ship). No foreign currency is accepted as guarantee due to the fluctuations in the exchange rates and in accordance with the Article 1 of the Law No. 805.

 

b) The sale takes place against cash payment. The buyer may be given a time of up to seven days maximum for the payment as applicable. The contract value is deposited to the cash desk of the Execution Office even though an objection is filed against the auction (Article 134/4). Brokerage commission, auction stamp, title deed fees and charges, and value added tax are collected from the customer separately.

 

c) By participating to the auction, the bidders are deemed to have accepted to bid in the auction after reviewing the execution file, the ship's registration records, specifications, and the relevant announcements and notifications, and that they have considered the legal consequences and liabilities arising from the the ship's registration records and its complementary parts, if any.

 

d) Since no order table is prepared for the payment of the lien in practice and for the sale on account of the receivables despite the compulsory provisions of the Articles 140, 151 and 268 of the EBL; those who have attachment, mortgage, promise of sale and other rights on the movable property are required to follow the auction process, use their right of action and submit their petition with their explanations on their objections and complaints to the order and original sum of receivables of institutions  like Social Insurance Agency and Social Security Agency for the Artisans and the Self-Employed, and that they should use their right of action within 7 days following the date of sale in accordance with Articles 100, 151 and 268 of EBL and the Law No. 4792.

 

e) Mortgage holders and other concerned parties (*) are also required to submit their rights on the subject property and their claims for the interest and other charges in particular to our office together with the evidential documents within 15 days. Otherwise, they will be exempted from the allocation unless their rights are registered in the registry office.

 

f) Bidders and the guarantors who join the auction but cause its cancellation by not paying the bid sum subsequently are jointly and severally liable for the difference between the sum of their bids and the final auction price, as well as other losses and the default interest starting from the 10th day they are required to deposit the sale price. The difference in the auction price and the default interest will be collected by our Execution Office without any need for a court decree, and this sum will be collected from the deposited guarantee, if any.

 

g) These specifications can be seen by everyone in our Office starting from the date of the announcement, while potential bidders can get a copy of it against the payment of the stamp fee.

 

h) It is hereby declared that by participating to the auction all bidders will be deemed to have seen the specifications and accepted its content, and that more information can be provided at our Office upon application to our Office with reference to the File No. 2013/32306.  20.01.2014

NOTICE OF A DECISION ON AN APPLICATION FOR AN ORDER GRANTING DEVELOPMENT CONSENT

 

The Secretary of State for Transport gives notice under regulation 23 of the Infrastructure Planning (Environmental Impact Assessment) Regulations 2009 that a decision has been made on an application by Able Humber Ports Limited (“AHPL”) of Able House, Billingham Reach Industrial Estate, Billingham TS23 1PX for an order granting development consent under the Planning Act 2008 (“the application”).

The application was for powers to construct and operate a new quay with associated onshore facilities (collectively referred to as the Able Marine Energy Park) on the south bank of the River Humber, north of Immingham, in North Lincolnshire, together with a compensatory environmental habitat on the north bank of the Humber, in the East Riding of Yorkshire. The Order would also authorise AHPL to acquire, compulsorily or by agreement, land and rights in land and to use land for the purposes of the project.

The Secretary of State has decided, following consideration of the report of the Panel who conducted an examination into the application that development consent should be granted for the project, and therefore has decided to make an Order under section 114(1) of the Planning Act 2008.

The Order will not come into force until it has been laid before Parliament and has been brought into operation in accordance with the provisions of the Statutory Orders (Special Procedure) Acts 1945 and 1965.

The statement prepared under section 116(1) of the Planning Act 2008 and regulation 23(2)(d) of the Infrastructure Planning (Environmental Impact Assessment) Regulations 2009 containing the content of the decision, the requirements imposed in connection with the development, the main reasons and considerations on which the decision is based including relevant

information about the participation of the public, the main measures to avoid, reduce and offset any major adverse effects of the development, and information regarding the right to challenge the decision and the procedures for doing so, can be viewed on the Planning Inspectorate’s website (www.planningportal.gov.uk/infrastructure) and at the following locations:
