The Hinkley Point Harbour Empowerment Order 2012 (HEO) conferred authority on NNB GenCo to carry out the functions of a Statutory Harbour Authority (SHA) at Hinkley Point, Somerset.

To undertake these responsibilities, NNB GenCo has constituted a Harbour Authority known as the Hinkley Point C Harbour Authority (HPCHA).

Pursuant to the powers within the HEO, HPCHA has developed General Directions for the purpose of assisting safe navigation within HPCHA waters. Following consultation with relevant parties, HPCHA hereby publishes its General Directions.

NOTICE OF A DECISION ON AN APPLICATION FOR AN ORDER GRANTING

DEVELOPMENT CONSENT

 

The Secretary of State for Energy and Climate Change (“the Secretary of State”)gives notice under regulation 23 of the Infrastructure Planning (Environmental Impact Assessment) Regulations 2009 that a determination has been made on an application by East Anglia One Limited c/o East Anglia Offshore Wind Limited, 3rd Floor, 1 Tudor Street, London EC4Y 0AH for an Order seeking development consent under the Planning Act 2008 (“the application”).

 

The application was for the construction and operation of a wind farm comprising up to 325 wind turbine generators with an installed capacity of up to 1200MW and export cabling off the coast of Suffolk and other infrastructure and works integral to the construction and operation of the wind farm to be located between Bawdsey and Bramford in Suffolk.

 

The Secretary of State has decided, following consideration of the report of the Examining Authority who conducted an examination into the application that development consent should be granted for the project, and therefore has decided to make an Order under sections 114, 115, 120 and 149A of the Planning Act 2008.

 

The statement of reasons for deciding to make an order granting development consent prepared by the Secretary of State under section 116(1) of the Planning Act 2008 and regulation 23(2)(d) of the Infrastructure Planning (Environmental Impact Assessment) Regulations 2009 containing the content of the decision, the requirements imposed in connection with the development, the main reasons and considerations on which the decision is based including relevant information about the participation of the public, a description of the main measures to avoid, reduce and offset any major adverse effects of the development, and information regarding the right to challenge the decision and the procedures for doing so, is published on the Planning Inspectorate’s website:

EAST ANGLIA THREE OFFSHORE WINDFARM ORDER

NOTICE PUBLICISING A PROPOSED APPLICATION FOR A DEVELOPMENT CONSENT ORDER (DCO)

 

Notice is hereby given that East Anglia THREE Limited (the Applicant) of 4th Floor, 1 Atlantic Quay, Glasgow G2 8JB  proposes to apply to the Planning Inspectorate (PINS) under section 37 of the Planning Act 2008 for the above-mentioned development consent order (the Application).

 

The Application relates to the construction and operation of an offshore wind generating station within the East Anglia Zone of the North Sea (the Project), which is 69km from the coast  at Lowestoft, covering an area of approximately 305km2. 

 

The proposed Project, together with the East Anglia FOUR Offshore Windfarm, comprises the next stage of development (“phase 2”) in the East Anglia Zone.  East Anglia ONE Offshore Windfarm (“phase 1”) was the first to be proposed within the East Anglia Zone and a decision on this application is expected in June 2014.  East Anglia FOUR will be subject to separate statutory consents and approvals.   

 

The proposed DCO would, amongst other things, authorise:

 

1. Offshore wind turbines and associated  foundations (up to 172 wind turbines to provide an installed capacity of up to 1,200MW)

2. Up to two meteorological masts and foundations

3. Up to two LiDAR (Light Detection and Ranging) monitoring buoys

4. Up to five offshore platforms with foundations to support transformer substation / converter stations

5. Up to one offshore platform housing accommodation facilities

6. Sub-sea cables between the wind turbines and offshore platforms

7. Up to four offshore sub-sea export cables to transmit electricity from the offshore platforms to the shore

8. Scour protection around the foundations and on inter-array, interconnecting and export cables if required

9. A landfall site at Bawdsey, Suffolk, with onshore transition pits to connect the offshore and onshore cables

10. Up to four onshore underground cables, running for approximately 37km from landfall to the connection point at Bramford, Suffolk, with jointing pits, to transmit electricity to a new onshore substation

11. Up to four cable ducts for pull-through of cables for the proposed East Anglia FOUR project

12. An onshore transformer substation / converter station at Bramford, Suffolk, to connect the offshore windfarm to the National Grid

13. The permanent and / or temporary compulsory acquisition (if required) of land and / or rights for the proposed Project

14. Overriding of easements and other rights over or affecting land for the proposed Project

15. The application and / or disapplication of legislation relevant to the proposed Project including inter alia legislation relating to compulsory purchase

16. Such ancillary, incidental and consequential provisions, permits or consents as are necessary and / or convenient.

Such loss, damage or infringement in respect of which the Parties are entitled to limitation are those mentioned in Article 2, paragraph 1, other than Article 2, paragraph 1(d) and (e) of the Convention on Limitation of Liability for Maritime Claims, 1976.

 

The limit of the Parties’ liability has been fixed at S$ 3, 646, 450. 57. The Limitation Decree has been granted without admission of liability on the part of the Parties.

Notice of proposed application for a development consent order (DCO) to construct and operate the offshore wind farm Rhiannon Wind Farm

Notice was given in March 2014 that Rhiannon Wind Farm Limited (the Applicant) of Millstream, Maidenhead Road, Windsor, SL4 5GD intends to apply to the Secretary of State under section 37 of the Planning Act 2008 (“The Act”) for a development consent order (DCO) to authorise the construction and operation of Rhiannon Wind Farm (“the Development”)

Rhiannon Wind Farm is the first wind farm proposed in the Irish Sea Zone in the Irish Sea.  It covers a total area of 497km² and is situated 19km off the coast of Anglesey, 34km from the Isle of Man, and 60km from Cumbria.  It is proposed to have a generating capacity of up to 2.2GW.   Given that the generating capacity of the Development is more than 100 megawatts, an application for development consent is required to be made to the Secretary of State under the provisions of the Act.

The Applicant’s proposed application to the Secretary of State seeks development consent for the construction and operation of Rhiannon Wind Farm and will incorporate the following elements:

 

Offshore 

Up to 440 wind turbines with supporting tower structures, foundations fixed to the seabed and associated support and access structures;

Up to 8 Alternating Current (AC) offshore substations;

Up to 4 Direct Current (DC) offshore converter substations;

Up to 4 accommodation platforms;

Intra-array cables laid on or beneath the sea bed between turbines and substations;

Up to 12 export cables laid on or beneath the sea bed which would bring the power to shore on the Isle of Anglesey

Ancillary works including: cable and pipeline crossing structures; protection against foundation scour and subsea damage, cable protection measures and vessel-mooring facilities

Offshore Works within Welsh Territorial Water associated with Rhiannon Wind Farm do not form part of the DCO application and will be consented by separately under the Marine and Coastal Access Act 2009.

Onshore works associated with Rhiannon Wind farm will be located on the Isle of Anglesey and do not form part of the DCO application.  These will be consented separately under the Town and Country Planning Act 1990 and will be subject to a separate Environmental Impact Assessment under the Town and Country (Environmental Impact Assessment) Regulations  2011 (as amended).    

The DCO will include a number of other provisions, including those which:

allow all or part of the benefit and rights of the DCO to be transferred to other person(s); and include a deemed Marine Licence.

The Development is “EIA development” for the purposes of the Infrastructure Planning (Environmental Impact Assessment) Regulations 2011 (as amended).   The Application includes an Environmental Impact Assessment and the Applicant will be consulting the public on the anticipated environmental impacts of the proposals, as well as the overall proposal. Accordingly, the Applicant will be making preliminary environmental information (PEI) available during the consultation period. The notice published in March 2014 stated that the PEI consisting of documents, plans and maps showing the nature and location of the proposed development, including the preliminary information compiled to date on environmental impacts, would be available to download from 20 March 2014 on http://www.celticarray.com   and to view from 20 March 2014 to 19 May 2014, during opening hours at the places set out below.  That period is now extended to 3 July 2014 and details of how to submit any comments or further comments are given in paragraph 10 below.. The PEI also includes a draft Environmental Statement and draft Non-Technical Summary of the Environmental Statement and will include some information about the onshore works.
